1. Contractual Agreement

By accessing and using PocketMenu, you agree to comply with and be bound by these Terms of Service. If you do not agree, please do not access or use the Service.

2. Use of Service

PocketMenu grants you a non-exclusive, non-transferable, revocable license to use our platform to build, modify, publish, and host digital menus.

  • You must be at least 18 years of age or represent a legally recognized business entity.
  • You are solely responsible for keeping your login credentials confidential.
  • You agree not to upload any fraudulent menu items, unauthorized logos, or deceptive pricing models.

3. Pricing, Payments & Subscriptions

We offer Free tiers and Pro plans. If you subscribe to a Pro plan, you agree to all recurring fee invoices. Subscriptions may be canceled at any time, and billing stops at the end of your billing cycle. No partial month refunds are guaranteed unless required by local consumer protection laws.

4. Content Accuracy & Food Allergens Liability

PocketMenu provides hosting and design templates for menus. We do not verify the ingredients, health ratings, pricing, or allergen disclosures (such as "Gluten-Free" or "Veg Only" tags) listed by café owners.

Café owners assume 100% of the liability for allergen disclosures, food safety regulations, pricing discrepancies, and claims made by customers. PocketMenu is not liable for customer illnesses, allergic reactions, food safety violations, or pricing disputes.

5. Intellectual Property & Content Ownership

You retain full ownership of all content you upload to PocketMenu, including but not limited to business logos, menu item images, descriptions, and pricing information.

  • License Grant: By uploading content, you grant PocketMenu a non-exclusive, worldwide, royalty-free license to host, display, and distribute that content solely for the purpose of providing the Service (e.g., rendering your public menu page).
  • License Termination: This license is automatically revoked when you delete the content or your account. After account deletion, your content will be removed within 30 days as described in our Privacy Policy.
  • PocketMenu IP: The PocketMenu name, logo, interface designs, menu themes, and underlying code remain the intellectual property of PocketMenu. You may not copy, modify, or redistribute any part of the platform.

6. Limitation of Liability

PocketMenu is provided on an "as is" and "as available" basis without any warranty. In no event shall PocketMenu, its founders, or affiliates be liable for any lost profits, lost revenue, or indirect, incidental, or consequential damages resulting from website downtime, menu errors, or database connectivity issues.

7. Indemnification

You agree to indemnify, defend, and hold harmless PocketMenu, its founders, employees, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising out of or related to:

  • Your use of the Service or violation of these Terms
  • Content you upload, publish, or make available through the Service
  • Any claims by third parties (including customers) related to your menu content, allergen disclosures, pricing, or business practices
  • Your violation of any applicable law or regulation

8. Service Modifications and Account Suspension

We reserve the right to suspend accounts or digital menu access for any owner violating these terms, posting inappropriate contents, or failing to pay subscription balances.

9. Governing Law & Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of India. Any disputes arising from or relating to these Terms or your use of PocketMenu shall be subject to the exclusive jurisdiction of the courts in Kolkata, West Bengal, India.

10. Changes to These Terms

We may update these Terms of Service from time to time. When we make changes, we will update the "Effective Date" at the top of this page. For material changes that affect your rights, we will make reasonable efforts to notify registered users via email at least 15 days before the changes take effect. Your continued use of PocketMenu after any changes constitutes acceptance of the updated terms.
